ARTICLE 1. FIELD OF APPLICATION

Present conditions aim to define the modalities of sale between Dadgad Music and any physical or moral person, hereunder named the customer, willing to buy via the website of Pierre Bensusan, http://pierrebensusan.com These conditions prevail on all other conditions existing on other documents, except special derogation duely written. Present terms and conditions can be amended at any time by Dadgad Music, under the reserve that they are visible on the website http://pierrebensusan.com. Only the terms and conditions written in the original language (French) are to be considered. This version has been translated in order to help our foreign customers to understand our conditions of trade, but cannot be considered as an original legal document.

ARTICLE 2. ORDERS

Orders can be placed : - via Internet, on http://pierrebensusan.com, 24h/24, 7/7 days. As indicated in the introduction, the validation of any order implies the full acceptance, without any reserve, by the customer of the general terms of trade. The data recorded by Dadgad Music constitutes the proof of the global transactions passed between Dadgad Music and the customer.
Data stored by the payment system, PayPal, constitutes the proof of the financial transactions. Information supplied by the customer during the ordering process, engages the customer. In case of error in the shipping address indicated by the customer, Dadgad Music cannot be responsible for not being able to deliver the goods.

ARTICLE 3. PRICES

Price is expressed in Euros. Invoices are issued in Euros.
The indicated price doesn't include the delivery costs. Price is indicated all taxes included. It takes into account the French VAT applicable at the time of order. Any governemental amendment of the VAT rate will apply on the invoice.
For each order an invoice is sent by E-Mail and a copy is included with the delivery. This invoice shows the detail of the items, and quotes the delivery costs.

ARTICLE 4. DELIVERY COSTS

Delivery costs include handling, packaging and shipping costs.
They are preset, based on the country of destination, the mode of delivery and the amount of the order.
Shiping prices are likely to be modified at any time.
Only the delivery costs mentioned in the orders confirmed by Dadgad Music are contractual.

From 500g, shipment is made by Air Mail, Priority, with Registration. Orders whose weight amounts less than 500g will be sent Air Mail - Priority, without a registration. Only the "Secured Shipping" via Registration option is subject to a proof of reception by the customer. Since the Priority Shipping doesn't allow proof of reception, the customer accepts to assume the inherent risks unless he chooses to have his order sent with a registration when weignt is under 500g, in which case, the customer should notify the company Dadgad Music by E-mail. The company will then charge the customer of the extra registration cost.

ARTICLE 5. SETTLEMENT

Full payment is due at time of placing order.
Payment is processed :
- By Credit Card (CB,Visa,Mastercard/Eurocard). You must indicate during your validation, the number of your card (16 digits), the expiration date, the 3 security key digits at the back of your card, directly in the correspondant fields (Secured socket Layer, sent through our secured payment system PayPal, which is the only one to receive your credit card informations).

ARTICLE 6. DELIVERY

We deliver to your home, or to any address you have selected.
The average lead time is of 5 to 15 opened days upon reception of the payment.

Nevertheless, Dadgad Music could not be considered responsible in case of delays or out-of-stock problems due to our suppliers.
If an item is temporarily unavailable with our suppliers, Dadgad Music will contact the customer by Email or Phone in order to inform him. The customer will then have the possibility of either cancel the order or ask Dadgad Music to keep it on records as backorder.
If the customer is non delivered within 30 days, he will be able to cancel his order and will be reimbursed. In case of temporary unavailability of one or several items, Dadgad Music can split the delivery. The supplementary delivery costs will then be paid by Dadgad Music.

ARTICLE 7 - SATISFIED OR REIMBURSED

You have a return right of 10 days after the reception date of the delivery by Dadgad Music (the stamp of the post making the proof).
This return must be done in the original packaging to obtain the repayment or exchange with an item of the same value. When returned to us, CDs & DVDs or any product must be in their original packaging and left un-opened.

If the item is returned because you are not satisfied: we would reimburse the item, but the re-expedition costs would be at your charge.
If the item is returned because of an error of Dadgad Music, this one would be reimbursed and we would support the re-expedition costs.
In order to process your return, please indicate : your name, surname, full address, date and order number as well as your login.

A reimbursement cheque or a credit on your bank account will be proceeded within 15 days of receipt of your returned package. Reimbursment delay could be extended to 30 days, should Dadgad Music needs to go through specific technical checkings.
Items returned dirtied, broken or incomplete will not be accepted, nor reimbursed

ARTICLE 8 - SECURISATION AND CONFIDENTIALITY

Our website ordering through PayPal has a securisation system (SSL process - Secure Socket Layer). All your bank informations are protected and crypted.

CONFIDENTIALITY

Dadgad Music protects your personnal data. Dadgad Music may not give to partners informations collected about his customers. The first time you will order with Dadgad Music, you will create for yourself a login and a password. The login allows you to avoid reentering all your datas information for the next orders. Our website has been declared in France to the CNIL, under the number (being processed). ARTICLE 9 - RESPONSABILITIES LIMITATION

The titles presented in the catalogue of Dadgad Music have been entered with the data communicated by our suppliers. Dadgad Music cannot be responsible for the content of the works.
Informations about prices and products availability, as well as illustrations by images can be modifed at any time. Those informations will always be displayed.
Proposed items follow the French legislation. Dadgad Music denies all responsability if the item delivered doesn't respect the legislation of the delivered country.
Dadgad Music denies all responsability in case of non execution of the contract due to a Force majeure case (flood, war, ...)

ARTICLE 10 - DISPUTES

This regarding the country of the residence of the customer, the present contract falls under the French Law, which is the only one applicable.

Attribution of competence, in case of dispute, will be held through Court of Chateau-Thierry (France).
